These Terms of Service (the “Terms”) govern your access to and use of the websites, mobile experiences, and services operated by Aroma Shore (“Aroma Shore,” “we,” “us,” or “our”), and your purchase of any products from us (collectively, the “Services”). By accessing the Services, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy and Return Policy, which are incorporated by reference. If you do not agree to these Terms, do not use the Services or purchase our products.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT, A CLASS-ACTION WAIVER, AND LIMITATIONS ON OUR LIABILITY THAT AFFECT YOUR LEGAL RIGHTS.

1. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Services or place an order. By using the Services you represent and warrant that you meet these requirements and that all information you provide is accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We may refuse service, terminate accounts, cancel orders, or remove content at our sole discretion.

2. Trademark and Brand-Comparison Disclaimer (Important)

All product names, trademarks, service marks, trade dress, and copyrights referenced on the Services are the property of their respective owners. Aroma Shore is not affiliated with, endorsed by, sponsored by, associated with, or connected to any of the designers, brands, or manufacturers whose names may be referenced.

Our fragrance products are original interpretations created through independent chemical analysis and reproduction. When we describe a product as an “impression of,” “inspired by,” “our version of,” “type,” or by comparison to a designer or brand name, such references are made solely for descriptive and comparative purposes to convey the general scent character of our product. We do not represent, and you should not infer, that our products are original brand products, that they are identical to or genuine versions of any branded fragrance, or that they are produced, authorized, or licensed by any trademark owner. Any use of third-party brand names is nominative and comparative only and does not imply origin, sponsorship, or approval.

3. Products, Descriptions, and Availability

We attempt to describe our products accurately, but we do not warrant that product descriptions, scent notes, colors, images, weights, dimensions, pricing, or other content are complete, reliable, current, or error-free. Scent perception is inherently subjective and may vary by person, skin chemistry, application, temperature, and storage; descriptions are approximations and not guarantees of performance, longevity, or similarity to any other product. Products are offered subject to availability, and we may limit quantities, discontinue products, or refuse or cancel any order at any time.

4. Product Safety, Intended Use, and Assumption of Risk

Our fragrance oils, perfume oils, raw materials, candles, and related supplies are sold for external personal use or for lawful formulation, resale, and craft use only, and are intended for adults.

Products may be sold as raw materials, concentrates, intermediates, bases, or components and are not necessarily finished, ready-to-use consumer products. Depending on the item, a product may require dilution, formulation, compounding, blending, testing, curing, additional ingredients, or other processing before it is suitable for personal use, application, or resale. All products are provided on an “as is” and “as available” basis for this purpose. You are solely responsible for determining whether a product is suitable for your intended use, for performing your own testing and evaluation, and for properly finishing, formulating, diluting, labeling, and ensuring the safety, quality, and legal compliance of any finished product you create, use, or sell. We make no representation or warranty that any product is complete, finished, stable, or fit for use as a final product in the form delivered, and to the fullest extent permitted by law we disclaim all liability arising from the use of a product as a finished good without appropriate and competent processing. You assume all risk associated with treating, using, or reselling any product as a finished product.

By purchasing, you further acknowledge and agree to the following:

• External use only. Products are not food, drugs, cosmetics intended for ingestion, or medical products. Do not ingest. Keep away from eyes, mucous membranes, broken skin, children, and pets.
• Allergen / sensitivity risk. Fragrance materials may cause skin irritation or allergic reactions in some individuals. You are responsible for performing a patch test before use and for reviewing ingredients if you have sensitivities. Discontinue use and seek medical attention if irritation occurs.
• Dilution and formulation. Concentrated oils and raw materials must be properly diluted and handled in accordance with applicable safety standards (including IFRA guidance where relevant). You are solely responsible for safe handling, dilution, formulation, labeling, and end-use of any product you purchase or create.
• Flammability. Oils, candles, and certain supplies may be flammable. Follow all candle-burning and handling safety instructions. Never leave a burning candle unattended.
• No therapeutic claims. We make no claims that any product diagnoses, treats, cures, prevents, or mitigates any disease or health condition. Any aromatherapy or wellness references are for general informational purposes only and are not medical advice.
• Compliance. You are responsible for ensuring your use, resale, relabeling, or distribution of our products complies with all applicable laws and regulations, including labeling, safety, and import/export requirements.

You assume all risk arising from the use, misuse, handling, formulation, or resale of products purchased from us.

5. Pricing, Payment, and Errors

All prices are in U.S. dollars unless stated otherwise and are subject to change without notice. We strive for accuracy, but pricing or product errors may occur. We reserve the right to correct any errors and to cancel or refuse any order placed at an incorrect price, even after an order has been submitted, confirmed, or charged, in which case we will cancel the order and issue a refund. You authorize us (and our payment processors) to charge your selected payment method for the total amount of your order, including applicable taxes and shipping. You represent that you are authorized to use the payment method provided.

6. Coupons, Discounts, and Promotions

Coupon codes, discounts, loyalty rewards, and promotions are subject to the terms stated at issuance, are non-transferable, have no cash value, may be limited to one use per customer, may expire, and may be modified or revoked at any time. They may not be combined unless expressly permitted, and may not be applied retroactively. We reserve the right to void codes obtained through error, fraud, or in violation of these Terms.

7. Shipping, Title, and Risk of Loss

Estimated delivery times are not guaranteed. Title and risk of loss pass to you upon our delivery of products to the carrier. We are not responsible for carrier delays, lost or stolen packages once delivered to the address you provided, or for errors in shipping information you supply. Certain materials may be subject to shipping restrictions; you are responsible for providing a lawful, accurate, and accessible delivery address.

8. Returns and Refunds

Because our products are fragrance and personal-care items, many items are sold as final sale and are not returnable for hygiene and safety reasons once opened or used. Our handling of returns, exchanges, damaged-in-transit claims, and refunds is governed by our Return Policy. To the extent permitted by law, all sales are otherwise final.

9. Wholesale, Reseller, and Private-Label Terms

If you purchase for resale, distribution, or private/custom labeling, you are solely responsible for how you market, label, describe, price, and sell the products, and for compliance with all applicable laws, including trademark, advertising, labeling, and consumer-protection laws. You agree not to represent our products as genuine, authorized, or licensed branded products, and you agree to defend, indemnify, and hold us harmless from any claim arising out of your marketing, labeling, relabeling, formulation, or resale. Custom-label and made-to-order items are non-cancellable and non-refundable once production has begun.

10. Intellectual Property

All content on the Services—including text, graphics, logos, images, product photography, formulations, scent descriptions, and software—is owned by or licensed to Aroma Shore and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not copy, reproduce, scrape, republish, or create derivative works from our content without our prior written consent.

11. User Content and Reviews

If you submit reviews, comments, images, or other content, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display that content in connection with the Services and our marketing. You represent that you own or control the rights to the content and that it is not unlawful, infringing, defamatory, or otherwise objectionable. We may remove any content at our discretion.

12. Prohibited Conduct

You agree not to misuse the Services, including by: violating any law or these Terms; infringing intellectual property or other rights; submitting false or fraudulent orders; attempting to gain unauthorized access to the Services or other accounts; introducing malware; scraping or harvesting data; reselling in violation of Section 9; or interfering with the proper operation of the Services.

13. Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING SCENT SIMILARITY, PERFORMANCE, LONGEVITY, OR RESULTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AROMA SHORE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO THE SERVICES OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Aroma Shore and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services or products; (b) your handling, dilution, formulation, relabeling, resale, or distribution of products; (c) your violation of these Terms or any law; or (d) your violation of any third-party right, including any trademark, advertising, or consumer-protection claim arising from how you market or label products.

16. Dispute Resolution; Binding Arbitration; Class-Action Waiver

Please read this section carefully—it affects your legal rights. Any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any product (a “Dispute”) will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. Arbitration will be administered by a recognized arbitration provider under its consumer rules. YOU AND AROMA SHORE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. You may opt out of this arbitration agreement by sending written notice to us within 30 days of first accepting these Terms. If any portion of this section is found unenforceable, the remainder will continue to apply.

17. Governing Law and Venue

These Terms are governed by the laws of the State of [INSERT STATE], without regard to its conflict-of-laws rules. Subject to Section 16, you agree to the exclusive jurisdiction and venue of the state and federal courts located in [INSERT COUNTY/STATE] for any matter not subject to arbitration.

These Terms, together with the Privacy Policy and Return Policy, constitute the entire agreement between you and Aroma Shore regarding the Services.
